Council to consider Buzzy’s, East End Theater SUPs

The agenda for the Monday, October 14 meeting of City Council includes consideration of the amended SUP for Captain Buzzy’s and the SUP for the East End Theater redevelopment.

Ordinance 2013-202 authorizes the special use of the old East End Theater building at 418 North 25th Street for the purpose of authorizing a mixed-use development with a multifamily dwelling of up to 22 dwelling units and uses permitted in the UB Urban Business District.

Ordinance 2013-112 amends the original ordinance which allowed the special use at 2623 East Broad Street for the 3 apartments and the commercial use which became Captain Buzzy’s. The changes “reduce the restrictions placed upon the commercial space within the building, upon certain terms and conditions”, which essentially allows Buzzy’s to remain open an hour later and apply to be able sell beer and wine.

The main points seem to be:

  • The uses for the property are still limited to “coffee shop, or retail shop, or non-medical office, or one (1) additional dwelling unit.”
  • Latest hour of allowed operation changed from 9PM to 10PM (still 8PM on Sunday)
  • Removes language prohibiting the sale of alcoholic beverages; now specifies beer and wine allowed, on premises only
  • SUP subject to automatic review “upon a change in possession, a change in owner of the business, or a transfer of majority control of the business entity”
